Whose archive is it anyway?


ख़रीद फ़रोख़्त का ज़माना है, यारों और इस दौर में सब कुछ बिकाऊ है । बस ख़रीदने वाला एक अच्छा सा ग्राहक चाहिये । ज़रा से हाथ-पाँव मारो, एक दो इश्तिहार छपवा दो बड़े से किसी अख़बार में – बस, ग्राहक अपने आप खिंचा चला आयेगा । और जब सब कुछ बिकाऊ है ही, तो संगीत भी क्यों न बिके और ख़रीदा जाये ? ये अलग बात है कि इस नये दौर में संगीत का हाट-बाजार पहले लग जाता है, ग्राहकों को आकर्षित करने के लिये इश्तिहार छप जाते हैं, बेचने वाले और ख़रीदने वाले अलग अलग अन्दाज़ में अपने बेचने खरीदने के सिलसिले का गुणगान करने लगते हैं । मौन रहता है तो बस बेचारा कलाकार जिसके बनाये या रिकार्ड किये गये संगीत की बोली जल्द ही लगने वाली है । ये अन्याय नहीं तो और क्या है?

दुख तो इस बात का है कि अब कला के अनैतिक ख़रीद फ़रोख़्त में शामिल होने वालों में एक ऐसा नाम पिछले कुछ दिनों में सामने आया है, जिसे अब तक कलाकारों ने अपना मित्र, अपना हितैषी समझा था । जी हाँ, मुम्बई स्थित एन. सी. पी. ए. अर्थात नेशनल सेंटर फ़ार परफ़ार्मिंग आर्टस् ने अपने संग्रहालय का खजाना बेचने की दृष्टि से बोली लगाने के लिये ग्राहक जुटाने का कार्य जोर शोर से आरम्भ कर दिया है । पाठक ये जान लें कि इस संग्रहालय में भारतीय संगीत की हजारों ऐसी लाजवाब रिकार्डिंग संचित की गई हैं, जिनका मूल्य लगाना असंभव है । तबला नवाज़ अहमद जान थिरकवा, भारत रत्न एम एस सुब्बलक्ष्मी, सारंगी नवाज़ राम नारायण आदि भारतीय शास्त्रीय संगीत के सम्राट स्वरूप कलाकारों से लेकर लोक संगीत की न जाने कितनी दुर्लभ रिकार्डिंग इस संग्रह में शामिल हैं । इन्हें प्रतिध्वनित करते समय मुख्य कलाकारों व उनके साथ संगत करने वाले संगत कलाकारों से उनकी अनुमति ली गई या नहीं, कहना कठिन होगा । और जब अनुमति ली भी गई, तो केवल संग्रहालय में भारतीय संगीत के इतिहास को आने वाली पीढ़ियों के लिये सुरक्षित रखने के लिये। स्पष्ट रूप से उल्लेखित है कि उनका व्यावसायिक उपयोग नहीं किया जायेगा ।

इसके बावजूद आज इन्हें बेचने की तैय्यारी में जुटे एन. सी. पी. ए को कलाकारों से सलाह लेने का समय नहीं मिला । बिना कलाकारों से अनुमति या सलाह लिये ही, वे बेचने पर उतारू हैं और इसके लिये साज सामान जुटाने में व्यस्त हो गये हैं । चूँकि इस संग्रह में मेरी भी कुछ रिकार्डिंग शामिल थीं, मैंने अपने पति तबला वादक अनीश प्रधान (जिन्होंने वर्षों से अनेकों कलाकारों के साथ एन.सी.पी.ए में कार्यक्रम प्र्स्तुत किये हैं और जिन कार्यक्रमों की रिकार्डिंग भी सम्भवत: बिक सकती हैं) के साथ एन. सी. पी. ए. को ईमेल द्वारा सूचित किया कि हम एन.सी.पी.ए के इस रवैये को लेकर चिंताग्रस्त हैं और इसे कलाकारों के साथ विश्वासघात मानते हैं, जिसके फलस्वरूप हम इस खरीद फ़रोख़्त में उनका साथ न देने का मन बना लिया है । हमारी रिकार्डिंग हमें वापस दे दी जायें, और उन्हें बोली पर न चढ़ाया जाये । ईमेल हमने एन.सी.पी.ए की निर्देशिका श्रीमती विजया मेहता, एन.सी.पी.ए की एक अन्य कार्यकर्ता सुवर्णलता राव, व इस बाजारीकरण के लिये विशेष रूप से नियोजित ब्रिटिश सलाहकार ओवेन मर्टिमर को भेजा, पर उत्तर केवल मर्टिमर साहब से ही मिला । उनका कहना है कि एक बार ग्राहक तय हो जाये, फिर एक एक करके “केस टू केस बेसिस” पर कलाकारों से अनुमति ली जायेगी । उन्होंने यह भी बताया कि हमारी रिकार्डिंग हमें वापस देने की हमारी माँग को वे एन.सी.पी.ए के आला अधिकारियों तक शीघ्रतम पहुँचा देंगे । इस बात को भी दो सप्ताह हो गये, लेकिन आला अधिकारी अब तक हाथ पर हाथ धरे बैठे हैं । अन्य कलाकारों ने भी एन.सी. पी. ए को लिख पूछा कि आखिर ये सब किसकी सलाह से और कैसे हो रहा है । उन्हें भी मर्टिमर साहब का वही केस टू केस बेसिस वाला उत्तर मिला !

कलाकारों के अधिकारों से सम्बन्धित पश्नों का मर्टिमर साहब के पास एक ही उत्तर है, तो उनसे निम्नलिखित ढेरों प्रश्न पूछने का जी बन पड़ा :-

1. मर्टिमर साहब, व एन.सी.पी.ए. के आला अफ़्सरान, हम भारतीय कलाकारों ने एन.सी.पी.ए. की बिल्डिंग खरीदने का मन बना लिया है । हम इस काम के लियी पैसा लगाने वाले निवेशकों को बटोर रहे हैं और जब हमें उपयुक्त निवेशक मिल जायेगा तो आप चिंता न करें, हम आपसे पूछेंगे अवश्य कि आप बिल्डिंग बेचना चाहते हैं कि नहीं ! क्यों? कैसी रही?

2. आप किस ग्राहक को इस संग्रह ख़रीदने की अनुमित देंगे और क्यों ? उसे जो एन.सी.पी.ए को सबसे अधिक पैसा दे कलाकारों की जायदाद पर अपनी मिल्कियत स्थापित करेगा, और कलाकारों की ओर कुछ टुकड़े फेंक उन्हें कभी न मिलने वाली रायल्टी देने की झूठी दिलासा दे उनका मुँह बन्द करवायेगा ? या फिर उसे जो कलाकारों को मुँह माँगी फ़ीस देगा और आपकी ओर कुछ टुकड़े ठेल देगा ?

3. यदि एन.सी.पी.ए को आर्थिक कमी महसूस हो रही है तो आप अपनी बिल्डिंग शौक से बेचिये ना । कलाकारों की सम्पत्ति को बेचने का अधिकार आपको किस कलाकार ने दिया ?

4. अंत में, आपके आला अधिकारी हमारी रिकार्डिंग कब हमें वापस करेंगे?

    Dear Shubhaji,

    I read your post with great nterest. I can understand your anguish as an artist of not being consulted before the action was taken. However, as a listener and lover of music, let me also say I welcome such a move by all such archival facilities to release these precious recordings. I was delighted that DD released it’s rare TV recordings. They are very very valuable and should be released to people who care and revere them. They should not languish away in the archives available only to those people who make a physical trip to the location. It is not always possible.

    But, again I agree that the interests of the artists in question should be paramount. I do hope you can resolve this imbroglio and we can hear the music soon.

    Dear Ritu ji,

    Neither I nor any of the artistes protesting against NCPA are in principle, opposed to the idea of providing access to the contents of the archive. However, if it was accessibility that the NCPA intended to provide, then the first thing I imagine they should have done, is to provide a complete catalog of their collection on the Net, so that music lovers and students and researchers can at least find out the list of artistes, repertoire, and other details about the collection housed in the NCPA archives. You will agree with me that this would have been quite easy to do. And then, why not provide free online access to the entire collection after taking due permissions from the artistes? What is the need to invite tenders from record companies? Obviously what NCPA wants is for record companies to pay them for the collection. So what they will negotiate is a hefty fee for NCPA, after which artistes will be given some long lecture about the sad state of the music industry, and how the record company selected for this work is doing all of us a favor by promoting and propagating traditional music, and in return we should all settle for peanuts to be paid to us as royalty. Once in a really blue moon, we will be sent a rag for a royalty statement which will tell us that NCPA and the record company partnering them has spent so many lakhs in releasing our albums, and so until they recover that amount we will not be paid a royalty. Can you see the injustice of this situation? NCPA gets money, the company makes money, but what do the artistes get? Not even peanuts!

    Let me also inform you that I have asked NCPA not to include my recordings in the catalog for sale, and to return those recordings to me. Surely it is not unreasonable on my part to ask for a copy of my own recording. It is now over two months since I asked them for a copy, and I was told that my request would be forwarded to the appropriate authorities at NCPA. No reply was forthcoming from the “appropriate authorities” and after repeated reminders, I was told recently that they are taking legal advice regarding my request and will revert. How do you like that?

    I am all for a wikipedia like site for Indian music and would be happy to contribute my recordings for the such a site if it provides free access to all. But what NCPA is doing is absolutely unethical and it will set a tragic precedent for all sorts of other organizations, archives, collectors and institutions to rip off artistes royally! Please do not support such activities.

    Dear Shubhaji,
    I read your article in outlook sometimes back and here also and extend my complete support for your concern. You took right step to protact your rights, please keep it contd. till you get your matl. back, dont give up, we r all with you.

    I am a big fan of you. I work in rural development sector in MP and while moving in most remote areas with tribes n in forests, it is your songs which give me great relax. You see, world is full of bitter, non sensitive people who, dont open files unless people come on streets n shout (this I’ve seen in cases of poor tribes who dont get even the most basic needs to survive). But now, there is a flike of hope emerged, which I am telling you with hope that may be this could help you also.

    It is The Right To Information Act 2005. It is a great thing happened to us if we use it fully with courage. Please read it on Net and dont hasitate to use it. Believe me, you will get things moving fast in your favour.

    I think you are overreacting and have been overreacting on this topic for a while. While I admire yours and your husband’s music, I think you are being unreasonable on these issues.

    Classical music is at a stage where it needs expansion in whatever manner possible and trying to monetize it just stupid and idiotic on part of classical musicians. They need to expand the market now, give away as much as possible, train as many people as possible etc. Once the market expands, you will automatically get financially rewarded directly or indirectly.

    Moreover when you claim money on these performances, should all the money really go to you? What about the composers who composed these beautiful compositions. Do you pass on something to them everytime? What about your teachers and hundreds of talented teachers in the country, what do they get out of this. And I am sure you pay peanuts to your harmonium or sarangi players.

    Classical music is too vast and an artist’s performance is a culmination of work of several people before them, the person who thought of the raga, the composer, the teachers who spent countless hours with their students and money should rightfully go to all of them.

    You are anyways rolling in money, think of the countless who are still living middle class mediocre lives in almost every Indian city just because they decided to take up this vocation.

    Hi,

    I am delighted to be corresponding or rather blogging with someone who seems to be omnipresent. How else would you know how much money I am rolling in, how many peanuts I pay my colleagues, how much money I do not offer my gurus for singing their compositions and sundry other details.

    Nevertheless, I would like you to pause and think for a bit about the benefits that my stand on the NCPA sale of archival material would have for those countless other musicians for whom you have voiced your concern. The ones who don’t roll in money while I do. They too have performed at NCPA and would have been recorded as all concerts at the NCPA for the past several decades have been. Therefore, if their recordings are sold commercially, they too should benefit from the sales. And let me remind you that even the accompanists (the peanut and cashewnut earning ones too) would benefit from my stand, because as per Indian law they have equal rights over the recordings. Which is why many of them have also written to NCPA insisting their recordings not be sold without their permissions and without due payments being made to them.

    But if you think that their stand too is “stupid and idiotic” and unreasonable, you are welcome to your opinion.
